Verizon Fios Gigabit Connection Service

This Internet Service Upgrade Agreement ("Agreement") is entered into between Verizon Communications Inc., a Delaware corporation ("Verizon," "we," "us," or "our"), with its principal office located at 1095 Avenue of the Americas, New York, NY 10036, and the undersigned customer ("Customer," "you," or "your") identified in the account associated with this Agreement.
Subject to the terms and conditions of this Agreement, Verizon agrees to provide you with an upgrade to the Verizon Fios Gigabit Connection internet service plan ("Service"), which includes:
Actual speeds may vary based on device capabilities, network conditions, and other factors. Verizon does not guarantee specific speeds at all times.
Monthly Service Fee: $89.99/month for the Fios Gigabit Connection plan.
Equipment Fee: The Verizon Router is included at no additional monthly cost. Additional Wi-Fi Extenders may be added for $10.00/month each.
One-Time Fees:
Taxes and Surcharges: Applicable federal, state, and local taxes, fees, and surcharges will be added to your monthly bill. These may include but are not limited to Universal Service Fund fees, regulatory recovery fees, and applicable sales tax.
Auto Pay Discount: Enroll in Auto Pay with an eligible payment method to receive a $10.00/month discount, reducing your monthly rate to $79.99/month.
Billing Cycle: Your billing cycle begins on the date of service activation. Charges are billed in advance on a monthly basis. Partial months will be prorated.
Agreement Term: This Agreement has no minimum term commitment. Service is provided on a month-to-month basis.
Cancellation: You may cancel the Service at any time by contacting Verizon customer service at 1-800-VERIZON, through the My Verizon App, or by visiting a Verizon retail store. Cancellation will be effective at the end of your current billing cycle.
Equipment Return: Upon cancellation, you must return all Verizon-owned equipment within thirty (30) days. Failure to return equipment will result in an Unreturned Equipment Fee of up to $150.00 per device. Equipment must be returned in good working condition, normal wear and tear excepted.
Verizon will provide the necessary equipment for the Service as described in Section 2. All equipment provided by Verizon remains the property of Verizon and must be returned upon termination of Service.
Self-Installation: A self-installation kit will be shipped to your service address with step-by-step instructions. If you experience difficulties with self-installation, you may request professional installation at any time.
Professional Installation: If professional installation is selected, a Verizon technician will schedule an appointment within a 4-hour window. You or an authorized adult (18+) must be present at the service address during the installation appointment.
Inside Wiring: Verizon is responsible for the fiber connection to the Optical Network Terminal (ONT) at your premises. You are responsible for maintaining inside wiring from the ONT to your router and devices.
Your use of the Service is subject to Verizon's Acceptable Use Policy, which is incorporated herein by reference. You agree not to use the Service for any unlawful purpose, to distribute malware, to send unsolicited bulk communications (spam), or to engage in any activity that disrupts or interferes with the Service or Verizon's network.
Verizon reserves the right to suspend or terminate Service if you violate the Acceptable Use Policy. In cases of violation, Verizon will make reasonable efforts to notify you prior to suspension or termination, except where immediate action is necessary to protect the network or comply with legal requirements.
Verizon strives to maintain 99.9% network availability for the Fios fiber network. Planned maintenance will be conducted during off-peak hours when possible, and Verizon will provide advance notice of planned outages via email or the My Verizon App.
Verizon employs reasonable network management practices to ensure a quality experience for all users. These practices are consistent with FCC guidelines and are described in detail in our Open Internet Information Statement available at verizon.com/about/our-company/open-internet.
Your use of the Service is subject to Verizon's Privacy Policy, available at verizon.com/privacy. By using the Service, you acknowledge that Verizon may collect, use, and share certain information as described in the Privacy Policy, including:
You may manage your privacy preferences through the My Verizon App or by contacting customer service. Verizon will not sell your personal information without your affirmative consent.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, VERIZON'S TOTAL LIABILITY ARISING OUT OF OR RELATED TO THIS AGREEMENT SHALL NOT EXCEED THE TOTAL AMOUNT OF SERVICE FEES PAID BY YOU DURING THE THREE (3) MONTHS IMMEDIATELY PRECEDING THE EVENT GIVING RISE TO THE CLAIM.
IN NO EVENT SHALL VERIZON BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING BUT NOT LIMITED TO LOSS OF PROFITS, LOSS OF DATA, OR INTERRUPTION OF BUSINESS, REGARDLESS OF THE FORM OF ACTION OR THEORY OF LIABILITY.
VERIZON SHALL NOT BE LIABLE FOR ANY FAILURE OR DELAY IN PERFORMANCE RESULTING FROM ACTS OF GOD, NATURAL DISASTERS, GOVERNMENT ACTIONS, LABOR DISPUTES, EQUIPMENT FAILURES BEYOND VERIZON'S REASONABLE CONTROL, OR OTHER FORCE MAJEURE EVENTS.
Any dispute, claim, or controversy arising out of or relating to this Agreement shall be resolved through binding arbitration administered by the American Arbitration Association ("AAA") in accordance with its Consumer Arbitration Rules. You agree that any arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.
You may opt out of arbitration by sending written notice to Verizon within thirty (30) days of accepting this Agreement. If you opt out, disputes will be resolved in the state or federal courts located in the state of your service address.
This Agreement shall be governed by and construed in accordance with the laws of the state in which your service address is located, without regard to its conflict of law provisions, except to the extent preempted by federal law.
Verizon reserves the right to modify the terms of this Agreement upon thirty (30) days' written notice to you. Notice may be provided via email, through the My Verizon App, on your monthly bill statement, or by posting on verizon.com. Your continued use of the Service after the effective date of modifications constitutes acceptance of the revised terms.
If a modification materially affects your rights under this Agreement, you may cancel the Service without penalty within sixty (60) days of the effective date of the modification.
This Agreement, together with the Privacy Policy, Acceptable Use Policy, and any applicable tariffs or price lists, constitutes the entire agreement between you and Verizon with respect to the Service and supersedes all prior or contemporaneous communications, proposals, and agreements, whether oral or written.
